These Terms of Use ("Terms") govern your access to and use of the Helm website and web application (the "Service"), operated by Eidolon Publishing ("Eidolon," "we," "us," or "our").
1. The Service
The Service provides web-based access to tabletop RPG adventure content and reference material, including community-submitted content ("User Content").
2. SRD Material (CC BY 4.0)
Some material available on the Service is identified as being from:
- System Reference Document 5.1 (https://www.dndbeyond.com/attachments/39j2li89/SRD5.1-CCBY4.0License.pdf), and/or
- System Reference Document 5.2.1 (https://media.dndbeyond.com/compendium-images/srd/5.2/SRD_CC_v5.2.1.pdf).
That material is licensed under Creative Commons Attribution 4.0 International (CC BY 4.0).
Where content is SRD material, your rights to use that SRD material are governed by CC BY 4.0, and nothing in these Terms is intended to limit those rights.
See Licenses & Attributions at Licenses & Attributions.
3. Our Content
Except for SRD material (CC BY 4.0) and any content explicitly marked with a different license, the Service and its original content are owned by Eidolon and/or its licensors and are protected by applicable law.
4. User Content (Community Adventures, Uploads, Submissions)
4.1 License You Grant to Eidolon
By submitting User Content, you grant Eidolon a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and make your User Content available to the public through the Service, including for promoting the Service.
You retain ownership of your User Content, subject to any third-party rights and any licenses you choose to apply.
This license continues for as long as needed to operate the Service and fulfill legal or operational obligations, including backups, security, dispute resolution, and compliance requirements. If you delete User Content or close your account, we will stop public display of that content when reasonably practicable, subject to those obligations.
4.2 Your Responsibility for Submissions
You represent and warrant that:
- you own your User Content or have all rights needed to grant the license above;
- your User Content does not infringe third-party rights (including copyright, trademark, privacy, or publicity rights);
- if your User Content includes SRD material, you do not attempt to impose restrictions on SRD portions beyond CC BY 4.0.
4.3 Moderation and Removal
We may remove or restrict access to User Content at any time (for example, if we receive an infringement claim or content violates these Terms).
4.4 Copyright Complaints
If you believe content on the Service infringes your rights, contact contact@eidolonpublishing.com with enough detail for us to investigate and respond. For DMCA notice-and-takedown procedures, see DMCA Notice and Takedown Policy.
5. Acceptable Use
You agree not to:
- interfere with the Service's operation or security;
- use the Service to distribute malware or abusive content;
- use automated access in a way that unreasonably degrades Service performance or availability.
6. Disclaimers
The Service is provided "as is" and "as available." To the extent permitted by law, we disclaim warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the extent permitted by law, Eidolon will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.
8. Changes to These Terms
We may update these Terms from time to time. The date above indicates when these Terms were last updated.
